Terms of Service

These Terms of Service ("Terms") govern your use of the VibeCopilot website (vibecopilot.shop) and the VibeCopilot Unity plugin (together, the "Service"). By buying a plan or using the Service, you agree to these Terms.

1. The Service

VibeCopilot is an AI assistant that works inside the Unity editor. It can generate code, edit your scene, fix errors, and generate 3D models, based on the text you type. The Service relies on third-party AI providers and may change, improve, or evolve over time.

2. Your account & access key

• When you buy a plan, you receive a personal access key (token). Keep it private.
• You are responsible for all activity that happens under your key.
• Do not share, resell, or distribute your access key. We may suspend keys that are shared or abused.

3. Plans, billing & credits

• Plans are paid subscriptions billed monthly in advance through our payment processor, Stripe.
• Subscriptions renew automatically each month until you cancel.
• Each plan includes a monthly allowance (for example, a number of 3D generations and/or AI tokens). "Flash" AI is included without a usage limit.
• Unused allowances do not roll over to the next month.
• Prices may change; we will give notice of changes before they affect your renewal.

4. Acceptable use

You agree not to:

• Use the Service for anything illegal or to create harmful, infringing, or abusive content.
• Attempt to reverse engineer, resell, or rebuild the Service or its server.
• Abuse, overload, or attempt to bypass usage limits or security.
• Use automated means to extract credits or access beyond your plan.

5. AI-generated content

• The code, models, and scene changes the Service produces are generated automatically and provided "as is". They may contain errors and are not guaranteed to be correct, complete, or fit for any purpose.
• You are responsible for reviewing and testing anything you use in your project.
• As between you and us, you own the outputs you generate for your own projects, subject to the terms of the underlying AI providers.

6. Intellectual property

The Service, the plugin, the website, and the VibeCopilot brand are owned by us. These Terms do not give you any rights to our software other than the right to use the Service under your plan. Your own Unity projects remain yours.

7. Third-party services

The Service uses third parties such as Stripe (payments) and AI providers (Google, Anthropic, Tripo). Your use of those parts is also subject to their terms. We are not responsible for third-party services.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, projects, profits, or business, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the claim.

10. Cancellation & termination

You can cancel your subscription at any time; see our Refund & Cancellation Policy. We may suspend or terminate access if you breach these Terms or abuse the Service.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use of the Service after changes means you accept them.

12. Governing law

These Terms are governed by the laws of Romania and the European Union, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence still apply.
